![]() Topic: Ohio Auditor's Transfer FeePosted: 09 June 2010 at 10:30am |

Does anyone mind telling me how they are handling the Auditor's Transfer Fee (ours is 50 cents per parcel) on the GFE Settlement Statements.
I do not feel it is a recording fee to go on line 1201/1202 but I do not feel it is a Transfer Tax either for line 1203. If we put it on a separate line (line 1206) ProForm will only let me put it on the GFE Comparison Page by rolling it into Line 1203. Just wanted to know what some other companies were handling this. We have had lenders ask for this fee in Recording Charges and some in Transfer Taxes. Thank you in advance. Jeramey |

It's a transfer tax for the parcel is the consensus of my clients, and me, which might sway my clients on some things, but not this one. What I mean is, as their consultant, I can say what I want around this particular topic, and they are not going to use my opinion for much.
I don't believe there's any reason you can't put it on 1206, and have that roll into 1203 for GFE line 8. Of course IANAL. (I am not a lawyer) DanV Dayton, Ohio |

Hi Dan! We missed you at UsersGroup!
The issue of the Ohio Conveyance Fee has been a hot topic at OLTA. The consensus is that the 50 cents per parcel is a transfer fee payable by the seller. This is according to Ohio law O.R.C. § 319.54 (G) whcih states:
The county auditor shall charge
and receive fees as follows: (2) For the transfer or entry of land, lot, or part of lot, or the transfer or entry on or after January 1, 2000, of a used manufactured home or mobile home as de- fined in section 5739.0210 of the Revised Code, fifty cents for each transfer or entry, to be paid by the per- son requiring it; (3) For receiving statements of value and administer- ing section 319.202 of the Revised Code, one dollar, or ten cents for each one hundred dollars or fraction of one hundred dollars, whichever is greater, of the value of the real property transferred or, for sales oc- curring on or after January 1, 2000, the value of the used manufactured home or used mobile home, as de- fined in section 5739.0210 of the Revised Code, trans- ferred, except no fee shall be charged when the trans- fer is made. Therefore it is to be rolled into line 1203. Scott Stevenson wrote an interesting article on this topic in Title Topic and can be read in full at OLTA.org.
